BemaEnd User License Agreement (App Store)

This agreement covers the Bema app you install from Apple's App Store. It sits alongside our Terms of Service, which govern the service itself; where the two overlap, the Terms of Service win for the service and this document wins for the app on your device.
Apple requires a few specific things to be said in a custom license, so this document is more formal than the rest of our policies. The plain-English version: you may use the app on Apple devices you own, we are responsible for it (not Apple), and everything about your data is in the Privacy Policy.
1. Parties
This license is between you and Bema's founders, Lars Kellner, Manuel Teijeiro, Ian de Haan and David Nocero (together "Bema", "we"), not Apple. Once Bema's company is registered, it takes their place in this agreement. Apple is not a party to this agreement and does not own or take responsibility for the app or its content.
2. License
We grant you a non-transferable license to install and use the Bema app on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The app may be accessed by other accounts associated with you through Family Sharing or volume purchasing, where Apple allows it.
You may not copy, modify, reverse-engineer, decompile, or create derivative works of the app except where the law expressly permits it, and you may not rent, lease, lend, sell, or redistribute it.
3. Age
The app is rated for ages 13 and over on the App Store, and our Children's Privacy notice applies. Parent and guardian accounts must be held by adults.
4. Maintenance and support
We, not Apple, are responsible for maintaining and supporting the app. Support
is at getbemaai@gmail.com. Apple has no obligation to provide any maintenance
or support for the app.
5. Warranty
The app is provided "as is", as set out in section 10 of the Terms of Service. To the extent any warranty exists that cannot be disclaimed, and the app fails to conform to it, you may notify Apple, and Apple will refund the purchase price you paid for the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.
6. Product claims
We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including:
- product liability claims;
- any claim that the app fails to conform to a legal or regulatory requirement;
- claims arising under consumer protection, privacy, or similar law, including in connection with the app's use of HealthKit or HomeKit (the app uses neither).
7. Intellectual property
If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
8. Legal compliance
You represent and warrant that (i) you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.

10. Third-party terms
The app uses Apple's WebKit and Capacitor, an open-source framework licensed under the MIT License, and communicates with Anthropic's API for its AI features under Anthropic's usage policies. You agree to comply with any applicable third-party terms when using the app.
11. Third-party beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and that upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
12. Data
Everything about what the app collects and how it is used is in the Privacy Policy. In short: no advertising, no tracking, no sale of student data, and your work is yours.
13. Termination
This license ends if you delete the app or your account, or if we terminate it for breach of the Terms of Service.
